Terms of Use – Flumes AI

Flumes AI ("we", "us", "our") provides an AI-powered email assistant that helps users draft replies, classify emails, and manage follow-ups. By accessing or using our website, software, or services (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

1. Definitions

  • "User" means any individual who accesses or uses the Service.
  • "Content" means emails, text, preferences, and configurations provided by the User.
  • "Personal Data" refers to any information that can identify a natural person as defined by the GDPR.
  • "DPA" refers to the data protection obligations included herein under Section 10.

2. Term & Acceptance

These Terms are effective upon your first use of the Service and remain in effect until terminated in accordance with Section 12.

3. Description of the Service

Flumes AI enables users to connect their Google account and analyze email data to:

  • Generate reply drafts
  • Label/classify emails
  • Set follow-up reminders
  • Functionality may change as the product evolves.

4. User Obligations

By using Flumes AI, you agree to:

  • Provide accurate information and keep it up to date
  • Only connect email accounts you have legal access to
  • Review and approve all AI-generated content before using it
  • Comply with applicable laws including email, privacy, and data protection laws

You are responsible for your content and use of the Service.

5. Prohibited Use

You must not:

  • Reverse engineer, copy, resell, or sublicense any part of the Service
  • Use the Service to send spam or infringe on others' rights
  • Introduce malware or harmful code
  • Use the Service for unlawful or harmful purposes
  • Violation may result in immediate termination.

6. Google OAuth & Account Access

Flumes AI uses Google OAuth to securely access your Gmail metadata and message content.

We do not store your credentials or access data beyond what is necessary for the Service.

Our use of Google APIs complies with the Google API Services User Data Policy.

7. AI Content & Model Use

We use third-party AI providers (e.g., OpenAI) to process data strictly for reply generation and classification. We do not allow these providers to use your data for training. You acknowledge:

  • AI outputs are probabilistic and may be inaccurate
  • You remain responsible for reviewing any generated text

8. Intellectual Property

All rights in the Service, including software and design, remain with the operator of Flumes AI.

You retain rights to your own data and content.

You may not reuse, duplicate, or distribute any part of the system without permission.

9. Billing & Subscription Terms

We may offer free and paid subscription plans.

  • By subscribing, you authorize us to charge your provided payment method.
  • Fees are billed in advance on a recurring basis (monthly/yearly).
  • You may cancel at any time, but no refunds are provided for partial billing cycles.
  • We reserve the right to change pricing with prior notice.

10. Data Protection & DPA (GDPR-Compliant)

10.1 Roles

You are the Data Controller of your personal data; Flumes AI is the Data Processor.

10.2 Purpose of Processing

We process personal data solely to provide the Service: reply generation, classification, follow-ups, and performance improvement.

10.3 Security Measures

We implement appropriate technical and organizational measures:

  • Encryption at rest and in transit
  • Role-based access control
  • Use of secure cloud infrastructure (Supabase, Google Cloud)

10.4 Subprocessors

We may use subprocessors (e.g., Supabase, OpenAI) under strict agreements. A list is available on request.

10.5 Transfers Outside the EU

We ensure transfers outside the EU comply with GDPR, using Standard Contractual Clauses or Data Privacy Framework membership.

10.6 Data Subject Rights

You may request access, correction, deletion, restriction, portability, or object to processing. Contact: alex@flumes.ai

10.7 Retention

We retain data only as long as necessary for Service provision or legal compliance.

11. Confidentiality

Both parties agree to keep confidential all non-public information shared in connection with the Service. This obligation survives termination.

12. Termination

We may terminate your access if you breach these Terms. You may terminate by ceasing use and/or requesting data deletion. Upon termination:

  • Your license to use the Service ends
  • Stored drafts may be deleted
  • Payment obligations already incurred remain due

13. Limitation of Liability

To the extent permitted by law, Flumes AI shall not be liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees paid by you in the last 6 months.

We make no warranties regarding uninterrupted service or AI output accuracy.

14. Governing Law & Jurisdiction

These Terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.
